Terms of Use – WriteZone Community

1. Scope
These terms of use govern the use of the optional community area of WriteZone / WordTracker (hereinafter the “Service”), provided by Mathias Todisco (see Legal Notice). By signing up, you agree to these terms. Separate app terms of use apply to local use of the app.
2. Account
- An account is required for the community area (email + password or Sign in with Apple). You are responsible for keeping your credentials confidential.
- You confirm that your information is accurate and that you have reached the minimum age required under your local law.
- As a rule, one account is intended per person.
3. Scope of services & availability
The Service includes, among other things, profile, friends, activity feed, motivations, and competitions. We strive for high availability but do not guarantee it. We may change, extend, or discontinue features; we will communicate material changes within the Service.
4. User-generated content (UGC)
You are solely responsible for the content you submit (e.g. display name, posts, images, competition details) and grant us the non-exclusive right to store, process, and display it to the intended recipients within the scope of the Service.
4.1 Zero tolerance for objectionable content
A zero-tolerance policy applies to objectionable, abusive, or unlawful content and conduct. The following are prohibited in particular:
- harassment, bullying, threats, or hate speech against individuals or groups,
- depictions of violence, sexually explicit content, or content harmful to minors,
- discriminatory, defamatory, or slanderous content,
- spam, fraud, phishing, malware,
- infringement of third-party rights (copyright, trademark, personality rights),
- impersonation as well as unlawful content of any kind.
4.2 Reporting & blocking
Users can report and block objectionable content and other users via the functions integrated in the Service. Blocked users and their content are hidden in both directions.
4.3 Moderation
We review reports and will act promptly against allegedly infringing content or users – usually within 24 hours – by removing content and/or warning, suspending, or deleting the account concerned. There is no entitlement to a particular moderation decision.
We inform affected users about the removal of content or restrictions on their account, stating the essential reasons (Art. 17 of Regulation (EU) 2022/2065, DSA). You can direct objections to a moderation decision to hello@writezone.app.
5. User obligations
You undertake not to misuse the Service, in particular not to:
- circumvent security measures, rate limits, or reporting/blocking mechanisms,
- scrape the Service in an automated manner or overload it,
- harass other users or misuse their data.
6. Suspension & termination
You can terminate your account at any time. We may suspend access in whole or in part, or delete the account, in the event of violations of these terms. Competition contributions already transmitted to other participants are not retroactively withdrawn for consistency reasons.
7. Liability
The Service is provided “as is”. We are liable without limitation in cases of intent and gross negligence as well as for injury to life, body, or health. In cases of simple negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical of the contract. We accept no liability for third-party user-generated content.
8. Changes to these terms
We may amend these terms of use where there is a valid reason to do so (e.g. changes in the law, new or changed features) and the amendment does not unreasonably disadvantage you. We will inform you of material changes with reasonable notice before they take effect. You may object to the change until it takes effect or terminate your account; for material changes we will obtain your consent.
9. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
